There are three separate elements to the cost of a bankruptcy.
1) Attorney fee: Amount varies.
2) Two credit counseling classes: $12 each for a total of $24 (per person and per married couple.)
3) Court filing fee:
Chapter 7: $338
Chapter 13: $313
Chapter 11: $1,738
In my practice the attorney fee amount depends on the complexity of the case. More complex cases cost a little bit more, and less complex cases cost a little bit less. Cases brought by married people cost a little bit more, and cases brought by an unmarried person cost a little bit less. However, in all consumer Chapter 7 cases the attorney fee will be somewhere in the $2,000's. For a Chapter 7 bankruptcy you may pay the attorney fee in one lump sum or in installments before the case is filed, the choice is yours.
